These Terms of Use ("Terms") govern your use of the Protokoll application ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
Protokoll is a professional tool that helps property managers, landlords and agents document handover inspections, capture defects with photos and voice notes, collect signatures, and generate protocol documents.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and use the App in compliance with applicable law.
The App offers a free tier limited to three protocols and paid subscriptions: a Monthly Professional plan at €19.99 per month and an Annual Enterprise plan at €179.99 per year. Subscriptions are billed through your Apple ID. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store account settings. Prices may vary by region and are confirmed at purchase.
You retain all rights to the content you create, including photos, recordings, signatures and protocol data. You grant us a limited license to host and process this content solely to provide the service. You are responsible for having the necessary rights and consents to capture and store images, recordings and signatures of third parties.
You agree not to misuse the App, including by attempting to disrupt the service, reverse engineer it, or use it for unlawful purposes.
Protokoll assists in producing handover documentation but does not constitute legal advice. The legal validity and evidentiary value of any protocol depend on applicable local law and the circumstances of its use. You are responsible for ensuring your protocols meet your legal requirements.
The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties. We do not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the App. Nothing in these Terms excludes liability that cannot be excluded by law.
You may stop using the App at any time. We may suspend or terminate access for breach of these Terms or where required by law.
We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law rules, and subject to mandatory consumer protections of your country of residence.
